- Manufacturing or compounding of pharmaceuticals, dietary supplements, cosmetics, or foods.
- Any other use that would cause Research Products to be regulated as medicines, medical devices, or consumer products under applicable law.
6.4. You acknowledge that Research Products may have unknown or insufficiently characterized safety profiles in humans and animals and carry inherent experimental risks.
7. Customer Responsibilities and Assumption of Risk (Research Products)
7.1. Professional Customers are solely responsible for ensuring that purchase, possession, handling, storage, use, and disposal of Research Products comply with all applicable laws, regulations, institutional policies, and safety standards in their jurisdiction.
7.2. You warrant that you have appropriate qualifications, training, facilities, personal protective equipment, and safety protocols to safely handle Research Products and that your personnel are adequately trained and supervised.
7.3. You accept that any experimentation with Research Products is conducted entirely at your own risk and that Apex Biohacks cannot control or supervise your use of Research Products.
8. Orders, Contract Formation, and Right to Refuse
8.1. By placing an order via the Website, you submit an offer to purchase the Products listed in your order.
8.2. The contract is formed when we send you an order confirmation by email or otherwise explicitly accept your order.
8.3. We reserve the right, at our discretion, to refuse, cancel, or limit any order, particularly where we suspect Misuse, regulatory risk, fraud, breach of these Terms, or where Research Products appear to be ordered by a Consumer Customer.
8.4. If we cancel an order after payment has been taken, we will refund the full amount paid for the cancelled items.
9. Shipping, Delivery, and Risk of Loss
9.1. Shipping options, costs, and estimated delivery times are provided at checkout.
9.2. Unless otherwise agreed, we will deliver Products within 30 days from order confirmation, failing which you may have rights under EU consumer law (for Consumer Customers).
9.3. Risk of loss or damage to Products passes to you upon delivery to the delivery address specified in your order. For Professional Customers, risk may pass upon hand-over to the carrier, depending on the agreed Incoterms; such details will be stated in our shipping terms where applicable.
9.4. You must inspect Products promptly upon receipt and notify us of any visible damage, missing items, or non-conformity without undue delay.
10. Legal Guarantees, Non-Conformity, and Returns – Consumer Products (EU Consumers)
10.1. For Consumer Customers purchasing Consumer Products within the EU, you benefit from a minimum 2-year legal guarantee for lack of conformity under applicable EU and national law.
10.2. If a Consumer Product is faulty or does not conform to the contract, you may be entitled, free of charge, to request repair or replacement, price reduction, or a refund, depending on the circumstances and applicable law.
10.3. The legal guarantee applies irrespective of any commercial guarantees or return policies we may offer.
10.4. Specific procedures for returns and complaints (including contact details and return addresses) are provided on the Website and/or in your order confirmation. You must follow those instructions to enable us to assess and process your request efficiently.
11. Cooling-Off Period and Withdrawal Rights – Consumer Products (EU Consumers)
11.1. If you are a Consumer Customer purchasing Consumer Products within the EU via distance contract (online), you generally have the right to withdraw from the contract without giving any reason within 14 calendar days from the date you receive the Products, subject to the exceptions below.
11.2. To exercise the right of withdrawal, you must inform us of your decision to withdraw within the 14-day period, using the contact details provided in your order confirmation or on the Website. You may use the model withdrawal form provided by EU law, but this is not mandatory.
11.3. You must return the Products (at your cost unless otherwise stated) without undue delay and no later than 14 days from the day on which you notify us of withdrawal. Products must be returned in their original condition and packaging, subject to normal handling necessary to establish the nature, characteristics, and functioning of the goods.
11.4. We will refund all payments received for the withdrawn items, including standard delivery charges (if applicable), within 14 days of being informed of your decision to withdraw or upon receipt of the returned goods, whichever is earlier, using the same means of payment you used for the initial transaction unless you expressly agree otherwise.
11.5. Exceptions: The right of withdrawal may not apply, or may be limited, for certain categories of goods, such as sealed goods that are not suitable for return for health protection or hygiene reasons and were unsealed after delivery, or goods which are liable to deteriorate or expire rapidly. Whether an exception applies depends on the nature of the specific Consumer Product and applicable national law.
11.6. The right of withdrawal does not apply to Professional Customers purchasing Research Products.
12. Returns and Complaints – Research Products and Professional Customers
12.1. Due to the nature of Research Products (chemicals and experimental materials), returns are generally not accepted unless we delivered the wrong item, or the Research Product is demonstrably non-conforming to agreed specifications at the time of delivery.
12.2. You must notify us of any issue with Research Products promptly and in any event within a reasonable period after delivery, providing batch numbers, order details, and evidence of the non-conformity.
12.3. Where we agree that a Research Product is non-conforming, our sole obligation, at our discretion, is to either replace the Research Product or refund the purchase price for the non-conforming item.
